1. Who we are, and what these terms cover
This website is operated by Club Coaching LLC, 75 E 3rd St, Sheridan, WY 82801-3674, United States ("OFM OS", "we", "us", "our"). These Terms of Service govern your use of ofmoliver.com, ofm-os.com and our related landing pages, free trainings, webinars, downloadable resources, emails and SMS messages (together, the "Site").
By using the Site, registering for a training, or submitting a form, you agree to these terms. If you do not agree, do not use the Site.
Buying the programme is governed by a separate agreement. These terms cover the website and our free content. The OFMOS programme itself is sold under our Terms, Policies & Disclosures, which are presented to you in full before you pay. Where the two documents differ in relation to a purchase, the Terms, Policies & Disclosures apply.
2. Who the Site is for
The Site is aimed at owners and operators of existing OFM (creator-management) agencies and is intended for business use. You must be at least 18 years old and have the authority to enter into these terms on behalf of yourself or your business. The Site is not intended for consumers acting outside a trade or profession.
3. Free trainings, webinars and resources
We offer free live trainings, replays, playbooks and guides. To access them you give us your name, email address and sometimes your phone number. In return we may send you the resource itself, event reminders and joining links, and follow-up marketing about our paid programme.
Free content is provided as-is and for information only. We may change, reschedule or withdraw any free training or resource at any time.
4. Communications and consent
When you tick the consent box on one of our forms, you agree to receive emails and, where you gave a number, SMS messages from us at the details you provided, including event links, reminders and related marketing. Message frequency varies and message and data rates may apply.
You can opt out at any time: use the unsubscribe link in the footer of any email, reply STOP to any SMS, or email support@ofm-os.com. How we handle your data is set out in our Privacy Policy.
5. Intellectual property
All content on the Site, including text, video, graphics, frameworks, templates, SOPs and downloadable resources, is owned by Club Coaching LLC or licensed to us, and is protected by copyright and other intellectual property laws.
We give you a personal, non-transferable, non-exclusive, revocable licence to view and use our free resources for your own business. You may not copy, republish, resell, redistribute, or create derivative works from our content, or share paid materials or access credentials with anyone who is not entitled to them.
6. Acceptable use
You agree not to:
- submit false, misleading or third-party contact details to our forms;
- use the Site or our content for anything unlawful, or in breach of any platform's terms;
- scrape, harvest, spider or bulk-download the Site or our contact data;
- attempt to gain unauthorised access to the Site, our accounts or our systems, or interfere with their operation;
- resell, sublicense or commercialise our content, or pass it off as your own;
- record, reproduce or redistribute a live session without our written permission.
We may suspend or block access for anyone who breaches this section.
7. No guarantee of results
We do not guarantee any specific result, income, revenue or growth. OFM OS provides education and consulting, not an income opportunity.
Any figures, case studies, testimonials, screenshots or examples shown on the Site or in our advertising describe what specific clients did. They are not typical, are not promised, and are not a guarantee that you will achieve the same or any result. Your outcome depends on factors we do not control, including your own effort and implementation, your team, your creators, your market, and the rules of the platforms you operate on and how those rules are enforced.
8. Not professional advice
Nothing on the Site is legal, tax, accounting, financial, investment, medical or employment advice. It is general business information. Engage your own licensed professionals before acting on anything you read or hear here. Compliance with the terms of OnlyFans, Instagram, Meta, payment providers and any other third party is your responsibility.
9. No platform affiliation
OFM OS is not affiliated with, endorsed by, sponsored by or administered by OnlyFans, Instagram, Meta Platforms, Inc., or any other platform. Platform names are used only to describe the nature of the work.
10. Third-party links and services
The Site links to and embeds third-party services, including video hosting, scheduling, forms and payment processing. We do not control those services and are not responsible for their content, availability or practices. Their own terms and privacy policies apply to your use of them.
11. Availability
We aim to keep the Site available but do not guarantee uninterrupted access. We may change, suspend or discontinue any part of the Site at any time without notice.
12. Disclaimers and limitation of liability
The Site and all free content are provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law.
To the maximum extent permitted by law, Club Coaching LLC is not liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, lost revenue, lost data or business interruption, arising out of or relating to your use of the Site or our free content. Our total aggregate liability arising out of or relating to the Site and our free content will not exceed one hundred US dollars (US$100). Liability in connection with a purchased programme is governed by the Terms, Policies & Disclosures for that purchase.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud or fraudulent misrepresentation.
13. Indemnity
You agree to indemnify and hold harmless Club Coaching LLC and its officers, members and contractors against any claim, loss, liability or expense, including reasonable legal fees, arising out of your breach of these terms, your misuse of the Site, or your infringement of any third-party right.
14. Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. The courts of Wyoming have exclusive jurisdiction, except where mandatory law in your country of residence gives you the right to bring proceedings elsewhere.
15. Changes to these terms
We may update these terms from time to time. The effective date at the top shows the current version, and the version in force when you use the Site applies to that use. Continuing to use the Site after a change means you accept the updated terms.
